Terms of Service and Subscription
Terms for using ClapGen, monthly subscriptions, cancellation, withdrawal and consumer remedies.
Who provides ClapGen
ClapGen is the service brand of Deniz Sonu EI, a French individual entrepreneur operating as a micro-enterprise, SIREN 103 349 155, SIRET 103 349 155 00020, 8 RUE Sabran de Pontevès, 93240 Stains, France. Your contracting party is Deniz Sonu EI.
Customer support, complaints and legal notices: [email protected]; +33 7 80 75 05 25. Postal correspondence: 8 RUE Sabran de Pontevès, 93240 Stains, France. Telephone calls are charged at your operator’s normal rate; ClapGen adds no premium-rate fee.
These terms apply to the website and, when available, the monthly subscription selected at checkout. Keep a copy of the terms and the information shown for your order. Mandatory consumer protections continue to apply.
Eligibility and accounts
You must be at least 18 and legally able to enter a contract. If acting for a business, you must have authority to bind it. Use accurate account information, protect your sign-in credentials and tell us promptly if you suspect unauthorized access.
ClapGen is intended for international use where it is lawful and the relevant service is available. A feature, payment method or model may be unavailable in your country. The website and customer documentation are in English; this does not remove mandatory rights or information requirements applicable where you live.
An account is personal to its holder. Do not sell or share access, circumvent access controls or use another person’s account. You remain responsible for requests you authorize through your account, subject to applicable consumer and payment law.
Service and technical requirements
ClapGen provides browser-based tools for requesting AI-generated images and videos, using reference media and character features, and following generation activity. Available tools, models, settings and input limits appear in the relevant interface before a request.
You need an internet connection, a current browser supporting JavaScript, and the rights to any material you submit. Generation requests can run asynchronously. Processing times depend on the selected task, provider availability and queue; no fixed completion time is promised unless specifically stated for your order.
AI outputs can contain errors, distortions or unexpected content and may resemble outputs provided to others. Review results before publication or reliance. ClapGen is not a professional medical, legal or financial advice service. These characteristics do not exclude statutory conformity guarantees or remedies for a service that fails to meet the contract.
Monthly offers and total prices
The following monthly offers are prepared for launch. Amounts are in euros (EUR). The selected plan, monthly total, credit allowance and automatic renewal must be shown before you confirm checkout. The displayed consumer total includes applicable taxes and mandatory charges; ClapGen does not add an undisclosed charge after confirmation.
The business is registered under the French basic VAT-exemption scheme. VAT is not charged where that exemption legally applies. Applicable tax treatment and the final payable total are shown for the supported offer before a binding order.
Your bank may apply its own exchange rate or conversion charges if your account is in another currency. Those charges are determined by your bank.
- Starter: EUR 19 per month, with 1,900 credits per successful monthly payment.
- Pro: EUR 49 per month, with 5,200 credits per successful monthly payment.
- Ultra: EUR 129 per month with 13,400 credits; EUR 250 per month with 27,800 credits; or EUR 375 per month with 42,300 credits.
Availability and use of credits
Paid credit redemption is not currently available. Subscription purchases remain unavailable until the service provides the corresponding credit-use information and functionality. A displayed monthly offer does not currently allow you to make a paid subscription order.
Credits are service accounting units, not money, a deposit or an investment. They have no cash value and cannot be sold or transferred between accounts. This does not limit a refund or other remedy required by law.
When subscriptions are opened, a monthly allowance is recorded only after a confirmed successful payment. Canceling renewal alone does not delete credits already recorded. These terms impose no automatic credit-expiry period. Any future credit-use conditions must be provided before the corresponding paid offer is available.
Subscription contract and recurring payments
When checkout is available, you select the plan and expressly agree to its amount and automatic monthly renewal before proceeding to Viva.com hosted checkout. Confirming a paid order creates an obligation to pay the displayed total. The subscription has no fixed end date and renews monthly until canceled; there is no minimum commitment beyond a paid monthly period.
The first confirmed payment starts the billing period shown in Billing. Subsequent renewals use the original monthly anniversary. If a month does not have that day, the boundary falls on its last day. The plan, confirmed amounts, payment status and next billing boundary are available in Billing.
Viva.com processes payment details on its hosted checkout. ClapGen does not collect or store full card numbers or card security codes. A browser return message alone is not payment confirmation. A new monthly allowance is added only after the payment is verified.
An unsuccessful or unconfirmed payment does not grant a new allowance. If a payment is uncertain, check Billing and contact support before attempting another payment. A bank reversal or payment dispute may place the corresponding subscription and credits on hold while the payment is reviewed. A hold does not waive consumer rights.
Canceling automatic renewal
You can stop automatic renewal at any time from Billing by selecting the cancellation action and confirming it. The resulting status and the end date of the paid period appear in Billing. If you cannot access your account, send a clear cancellation request to customer support identifying the account and subscription.
Cancellation stops future renewal requests and takes effect at the end of the current paid period. It does not shorten the period you have already paid for or remove recorded credits merely because renewal is canceled. A payment already submitted before your request may still be reconciled; contact support if its timing or entitlement is disputed.
Stopping renewal and withdrawing from the initial contract have different effects. Cancellation alone does not create a refund for the current period, without affecting your withdrawal right, statutory guarantees or another legally required refund.
Fourteen-day withdrawal right
If you are a consumer, you can withdraw from your initial distance subscription contract without giving a reason within 14 days from its conclusion. The day of conclusion is not counted. If the final day is a Saturday, Sunday or public holiday, the period is extended to the following working day where French withdrawal rules apply.
Before the deadline, notify Deniz Sonu EI of your decision using the model below or another clear statement sent to the email or postal address shown here. Billing also offers a separate Withdraw from contract action and a dated downloadable acknowledgment. Keep your statement and acknowledgment as evidence. You do not have to use the model form or give a reason.
Registration, payment, receipt of credits and use of a feature do not by themselves waive your withdrawal right. ClapGen does not currently require an early-performance request or a withdrawal waiver. For a valid withdrawal within the statutory period, we refund the amount paid for the withdrawn contract without a usage deduction under these terms.
We make the refund without undue delay and no later than 14 days after receiving your withdrawal notice, using the original payment method unless you expressly agree otherwise, without a refund fee. A withdrawal declaration and any resulting refund are separate steps; a downloadable acknowledgment records receipt of the declaration rather than confirming that money has already been returned.
Withdrawal stops future renewal of the identified contract. Mandatory extensions of the withdrawal period, remedies for missing information and other consumer protections remain applicable. If you think those rules apply, contact support even if 14 days have passed.

Legal guarantees for continuous digital services
If you are a consumer, you may invoke the legal guarantee of conformity for a defect appearing at any time during the entire contractual period in which ClapGen continuously supplies the service, including each renewed monthly period. During that period you need to establish that the defect exists, not when it first appeared. ClapGen must provide the updates necessary to keep the service conforming throughout that supply period.
You are entitled to have the service brought into conformity without unjustified delay after your request, at no cost and without major inconvenience.
You may keep the service and obtain a price reduction, or end the contract and obtain the corresponding refund, if ClapGen refuses a remedy, unjustifiably delays it, imposes remedy costs on you, causes major inconvenience, or the defect persists after an unsuccessful attempt to remedy it.
If the defect is sufficiently serious, you may obtain a price reduction or end the contract immediately, without first requesting a remedy. For a minor defect, termination under this guarantee is available only where the contract does not require payment of a price.
A period during which the service is unavailable while being brought into conformity suspends the remaining guarantee period until a conforming service is supplied again. A price reduction reflects the lost value during the affected period. For continuous supply, amounts lawfully due for a conforming period already supplied may be taken into account; advance payments for a period after termination are refunded.
Guarantee refunds are made without undue delay and no later than 14 days after the seller is informed of your decision, by the original payment method unless you expressly agree otherwise, without a refund fee.
These rights arise under Articles L224-25-1 to L224-25-31 of the French Consumer Code. A professional who obstructs the guarantee in bad faith may incur a civil fine of up to EUR 300,000, which may be increased to 10% of average annual turnover under Article L242-18-1.
You also benefit from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. You may invoke that guarantee within two years after discovering the defect. It allows a price reduction if you keep the service or the applicable refund if you give it up.
These guarantees cannot be excluded by an AI-output disclaimer. To exercise them, contact Deniz Sonu EI at 8 RUE Sabran de Pontevès, 93240 Stains, France or [email protected], describing the problem and affected account or contract.
Your inputs, generated outputs and permissions
You retain the rights you hold in your prompts, reference media and other inputs. You give ClapGen the limited permission needed to store, reproduce, transmit and process those inputs to provide the functions you request, operate your account and resolve related support or legal issues. This is not a transfer of ownership.
Generation requests require sharing the selected prompt, references and relevant technical information with the providers used for that task. Read the Privacy Policy before submitting personal or sensitive material. Do not upload another person’s image, voice, personal information or protected work without a lawful basis and the necessary permissions.
ClapGen does not claim ownership of your inputs or outputs solely because you use the service. Outputs may not be unique or protected by copyright, and use can affect third-party rights. Check your intended use, including commercial use, before publishing. No promise of exclusivity or automatic clearance of intellectual-property, image or personality rights is made.
The ClapGen brand, website design, software and materials supplied by the operator remain protected by the rights of their owners. You may use the interface for its intended purpose and keep copies of your own records; these terms grant no right to resell the service or copy protected software or branding.
Responsible use and account restrictions
Do not use ClapGen to violate law or another person’s rights, produce sexual content involving minors, exploit or harass people, carry out fraud or deceptive impersonation, distribute malicious code, evade security controls, or interfere with the service or its suppliers. Do not submit payment details or passwords in creative prompts or uploads.
We may reject a request or restrict access when reasonably needed to address unlawful use, security threats, fraud or a serious breach of these terms. Where lawful and safe, we explain the reason and give you a way to contest a restriction through customer support. Urgent action may be taken first when necessary to protect people or the service.
A restriction is not a blanket forfeiture of money or mandatory remedies. Any subscription termination, payment dispute, refund and retention of necessary evidence are handled according to the actual circumstances and applicable law.
Service changes, interruption and account closure
We may maintain, secure and improve the service. Necessary updates must not remove statutory rights. If a proposed change has a material adverse effect on an ongoing consumer service, we provide the information and remedies required by law, including advance notice on a durable medium and a right to terminate where applicable.
These terms do not authorize an automatic increase to an existing subscription price. A change to the recurring amount requires clear advance information and a new agreement before the changed amount is charged. If an offer is discontinued, we notify affected subscribers, stop future renewals and honor any required refund for service not supplied.
You can request account closure or deletion of personal data by contacting [email protected]. Identify any subscription in your request so we can stop it. Account closure does not cancel a refund entitlement or a legal retention duty. Save the material and receipts you wish to keep before closing an account.
We do not exclude liability that cannot lawfully be excluded, including mandatory consumer remedies. If a paid service is unavailable or not supplied as agreed, contact support to obtain the remedy appropriate to the contract and applicable law.
Complaints and consumer mediation
Send a written complaint to [email protected] or to Deniz Sonu EI at 8 RUE Sabran de Pontevès, 93240 Stains, France. Include your account email, the relevant contract or payment reference, the problem and the remedy you are requesting. Keep a copy of your complaint.
Consumer mediation is an independent process intended to resolve an unresolved dispute without going to court. It is free for the consumer. Using mediation does not prevent you from bringing a claim before a competent court.
A mediation agreement is being arranged before consumer subscriptions open. No mediator is currently appointed for ClapGen. The appointed mediator’s contact details and referral procedure will be published here before consumer sales become available.
Applicable law and changes to these terms
French law governs these terms, without depriving a consumer of mandatory protections granted by the law of their habitual residence where those protections apply. You may bring a claim before a court competent under the applicable jurisdiction rules; these terms impose no exclusive foreign court or mandatory private arbitration.
The version accepted for a paid order governs that order, subject to lawful changes to an ongoing service. We publish the date and version of updated terms and notify affected customers where required. A new version does not retrospectively remove an accrued right or authorize an unagreed charge.
